Terms of Service

These Terms of Service (“Terms”) govern your use of the Got Insurance platform operated by COI Tracker LLC (“we,” “us,” or “our”) at gotinsurance.io. By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Got Insurance is a SaaS platform that helps general contractors track and manage subcontractor Certificate of Insurance (COI) compliance. Features include COI document upload and AI-powered parsing, compliance tracking, automated email and SMS notifications, and subscription-based account management.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Subscription and Payment

Got Insurance is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate.

Payments are processed by Stripe. You agree to Stripe's terms of service in addition to these Terms.

We reserve the right to change subscription pricing with reasonable advance notice. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

Subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Acceptable Use

You agree to use Got Insurance only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload documents you do not have the right to share
• Use the Service to harass, spam, or send unsolicited communications
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service in any way that violates applicable law or regulation

6. Subcontractor Data and SMS Consent

You represent that you have the legal right to enter subcontractor contact information into the Service, including phone numbers, and that you have obtained any necessary consent to send SMS notifications to those individuals on your behalf.

You are responsible for ensuring that your use of the SMS notification features complies with applicable law, including the Telephone Consumer Protection Act (TCPA).

SMS opt-out: Recipients of SMS messages sent through the Service may opt out at any time by replying STOP. You agree not to send messages to individuals who have opted out.

7. AI-Powered Document Parsing

Got Insurance uses artificial intelligence to parse and extract data from COI documents. While we strive for accuracy, AI parsing is not infallible. You are solely responsible for verifying the accuracy of parsed data and for all compliance decisions made based on information in the Service.

We make no warranty that AI-extracted coverage information is complete, accurate, or current. Do not rely solely on the Service as the basis for insurance compliance decisions without independent verification.

8. Intellectual Property

The Got Insurance platform, including its software, design, and content, is owned by COI Tracker LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription period.

You retain ownership of all data and documents you upload to the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE EXPRESSLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Got Insurance is a compliance tracking tool, not an insurance advisor or broker. Nothing in the Service constitutes legal, insurance, or financial advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COI TRACKER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless COI Tracker LLC, its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
